Le label de qualité Origine Expert:

Le label LOE de la société Origine Expert est un label de qualité décerné à des experts en biens mobiliers dans le cadre notamment de procédures de ventes volontaires. Le label LOE vise à accréditer un expert présentant non seulement une solide expérience dans la spécialité proposée mais s'engageant à respecter une déontologie stricte assurant une indépendance et un libre arbitre dans l'acte d'expertise.

Conditions d'accès au label LOE

- le candidat doit être une personne physique majeure
- le candidat doit présenter une ancienneté justifiée de 5 années minimum dans la spécialité proposée
- le candidat ne doit pas avoir fait l'objet d'une condamnation d'un tribunal dans laquelle sa qualité d'expertise a été mise en cause
- le candidat doit rassembler un dossier d'application regroupant principalement ses références dans la spécialité visée et notamment les ventes volontaires auxquelles il aurait participé en qualité d'expert ainsi que des référents dans sa spécialité

Octroi du label LOE

- le label LOE est décerné après examen du dossier d'application et audition du candidat expert par une commission (ci-après « la Commission »)
- la Commission n'a pas de composition fixe et Origine Expert se réserve le droit de faire appel à tout tiers pour siéger à la Commission notamment au regard de la spécialité proposée
- les décisions de la Commission sont sans appel sans que la Commission n'ait à justifier ses décisions
- le label LOE est décerné pour une période de 3 années à l'issue desquelles le candidat doit de nouveau être entendu par la Commission pour une éventuelle prorogation de sa labellisation
- la Commission se réserve le droit de retirer le label LOE à tour expert labellisé en cas de manquement à ses engagements et à en faire la publicité d'usage

Engagements du labellisé

- le labellisé s'engage à faire prévaloir les intérêts du client sur tout intérêt personnel
- le labellisé s'engage à s'astreindre lors de son expertise au respect de principes de probité, de conscience, de loyauté, de modération et de courtoisie
- le labellisé s'interdit de rendre une expertise sans avoir été en contact direct avec l'objet expertisé
- le labellisé a une obligation de moyens et s'engage à faire état de ses doutes à son client si tel est le cas et à recommander le cas échéant toute analyse scientifique pour étayer son expertise
- le labellisé est responsable des objets et documents qui lui sont confiées et est tenu de les restituer à l'achèvement de sa mission
- le labellisé s'interdit de recueillir des objets ou de mener à bien une mission d'expertise sans que sa responsabilité civil et professionnelle ne soit couverte par une police d'assurance
- le labellisé s'engage à continuer à progresser dans son art en particulier en enrichissant sa base documentaire et en se rendant sur les sites d'origine de sa spécialité
- le labellisé s'engage à une stricte discrétion sur l'origine des objets qui lui sont confiés pour expertise hormis consentement préalable du client ou cas déclaratifs prévus par la loi
- le labellisé s'interdit de délivrer des expertises sur des spécialités autres que celles pour lesquelles il a reçu un label LOE
- les engagements du labellisé sont matérialisés par écrit

 

The seal of approval LOE held by Origine Expert is a title recognizing the high quality of its experts, notably in aucitons. The title LOE aims to accredit an expert holding not only considerable experience in their area of expertise, but also respectful of strict ethical codes, guarenteeing an independent mediator in the role of expert.

Conditions to recieve the label LOE

-the candidate must be a major

-the candidate must present documentation of a minimum of five years in their propessed field.

-the candidate may not have a court conviction in which the quality of their expertise was in question.

-the candidate must put together a porfolio demonstrating their experience in their aimed speciality, notably in auctions in which they participated as an expert or consulant in their speciality.

 

Granting of LOE

-the title LOE is given after an application test and an audition of the candidate with a committee (here after « the Committee »)

-the Committee is not fixed, and Origine Expert holds the right call in a third party to sit in the Committee, particulary in regards to their proposed speciality.

-the decissions of the Committee are final and the Committee does not have to justify their descision

-the title LOE is issued for a period of three years at the end of which the candidate must again be considered by the Committee for an eventual extension of their certification.

-the Committee holds the right to revoke the title LOE given to the expert in the case of their failure to meet their commitments.

 

Commitments of certification

-the certified commits to pursue the interests of their clients over their personnel interests.

-the certified commits to restrict themself to their expertise and respect the priniciples of integrity, conscientiousness, of loyalty, of moderation and coutesy.

-the certified is not allowed to give an expertise without having direct contact with the object.

- the certified has an obligation to make clear to the client if he or she has doubts about an object, and if necessary recommend to the client any scientific analysis necessary to support his or her expertise.

-the certified is responsible for the objects and documents left with him or her, and must return them when finished with his or her studies.

-the certified is not allowed to collect the objects or lead an expert mission without his or her civil and professional responsability being covered by an insurance policy.

-the certified commits to continue to make progress in their art, in particular by increasing their reference documents and going to the sites of their speciality.

-the certified commits to strict discretion regarding the origin of the objects confided to him or her, except with prior consentment from the client or in cases when the law demands.

-the certified is not allowed to give his or her expertise outside their speciality for which they recieved the title LOE

-the commitments of the certified are put down in writing.
